1. Introduction

Gone (“App”) is operated by Motionary, Inc. (“Motionary,” “we,” “our,” or “us”), a Delaware corporation. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use the Gone mobile application.

We built Gone to help you discover travel destinations based on how you want to feel, not just where you want to go. We're committed to being transparent about our data practices and protecting your privacy.

By using Gone, you agree to the collection and use of information in accordance with this Privacy Policy. This Policy is incorporated into and subject to our Terms of Service.

2. Information We Collect

2.1 Account Information

When you create an account using Sign in with Apple, we receive:

  • Apple User Identifier: A unique, anonymous identifier provided by Apple that allows us to recognize your account
  • Email Address: Only if you choose to share it (Apple allows you to hide your real email using their private relay service)
  • Name: Only if you choose to share it

2.2 Information You Provide

  • Home Airport: Your preferred departure airport (e.g., “LAX”) to personalize flight searches
  • Saved Searches: Trip preferences you save, including destinations, travel vibes (such as “beach,” “romantic,” or “nightlife”), timeframes, duration, budget preferences, number of travelers, and flight preferences (maximum stops, flight duration, preferred departure and return times)

2.3 Voice Data

When you use our voice search feature:

  • Your audio recording is transmitted to a third-party service provider for transcription
  • The transcribed text is processed to extract your travel intent
  • Gone does not capture, store, or retain your voice recordings. Audio data is streamed directly to our service provider for processing and is not stored on our servers. We only retain the resulting text and extracted trip preferences.
  • Note: Our transcription provider may temporarily retain audio data for a limited period in accordance with their own data policies before deleting it.

2.4 Automatically Collected Information

  • Session Data: Authentication tokens to maintain your logged-in state
  • Usage Timestamps: When your account was created, last accessed, and when searches were saved or modified

2.5 Information We Do Not Collect

  • We do not collect precise geolocation data
  • We do not collect contacts, photos, or other device data
  • We do not collect payment information (all purchases are processed by Apple)
  • We do not use cookies or tracking pixels

4. How We Share Your Information

4.1 Third-Party Service Providers

We work with trusted third-party service providers to help deliver Gone's features. These providers are bound by contractual obligations to protect your data and only use it for the purposes we specify.

AI and Search Providers

  • Purpose: Voice transcription, search intent extraction, and semantic destination matching
  • Data Shared: Voice recordings (for transcription) and search queries
  • Note: Voice recordings are streamed directly to our provider and are not stored on our servers

Flight Data Providers

  • Purpose: Flight search and pricing data
  • Data Shared: Search parameters only (origin airport, destination, dates, number of travelers). No personal identifiers or account information is shared.

Destination Content Providers

  • Purpose: Destination photos and booking referrals
  • Data Shared: Place and destination queries

Infrastructure and Security Providers

  • Purpose: API hosting, content delivery, and security
  • Data Shared: API requests are routed through our provider's network

Apple

Analytics and Performance Monitoring

  • Purpose: Product analytics, app performance monitoring, and crash reporting to improve our services and stability
  • Data Shared: Random anonymous identifiers, anonymized event data (such as feature usage), performance metrics, and crash logs only. We do not share your email address, name, or any other personally identifiable information with these providers.

4.2 We Do Not Sell Your Personal Information

We do not sell, rent, or trade your personal information to third parties for their marketing purposes. We do not share your information with data brokers or advertising networks.

4.3 Other Disclosures

We may disclose your information if required to:

  • Comply with applicable laws, regulations, or legal process
  • Respond to lawful requests from public authorities, including law enforcement
  • Protect the rights, privacy, safety, or property of Motionary, our users, or the public
  • Enforce our Terms of Service
  • In connection with a merger, acquisition, or sale of assets (you will be notified of any change in ownership or use of your information)

5. Data Storage and Security

5.1 Where We Store Your Data

Your data is stored on secure servers provided by our infrastructure partners, with data centers located in the United States and other locations globally.

5.2 Security Measures

We implement appropriate technical and organizational measures to protect your information, including:

  • Encrypted connections (HTTPS/TLS) for all data transmission
  • Secure, cryptographically random session tokens
  • Database-level access controls
  • Apple's secure authentication infrastructure

5.3 Security Limitations

While we strive to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

When you delete your account, we delete or anonymize all associated personal data within 30 days. We may retain anonymized, aggregated data that cannot be linked back to you for analytics and service improvement purposes.

7. Your Privacy Rights

7.1 Rights for All Users

Regardless of where you live, you can:

  • Access your saved searches and account information within the App
  • Delete individual searches at any time through the App
  • Delete your account and all associated personal data through the App
  • Opt out of voice features by using text-based search instead

7.2 Additional Rights for European Users (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have the following additional rights under the General Data Protection Regulation (GDPR):

  • Right of Access: Request a copy of the personal data we hold about you
  • Right to Rectification: Request correction of inaccurate or incomplete personal data
  • Right to Erasure: Request deletion of your personal data (“right to be forgotten”)
  • Right to Restrict Processing: Request that we limit how we use your data
  • Right to Data Portability: Receive your data in a structured, machine-readable format
  • Right to Object: Object to processing based on legitimate interests
  • Right to Withdraw Consent: Withdraw consent at any time for processing based on consent (such as voice features)
  • Right to Lodge a Complaint: File a complaint with your local data protection authority

Data Controller: Motionary, Inc. is the data controller for your personal data.

Legal Bases for Processing: We process your data based on: (a) performance of our contract with you (providing the App's features), (b) your consent (voice processing), (c) our legitimate interests (improving services, security), and (d) legal obligations.

International Transfers: Your data is transferred to the United States. We rely on Standard Contractual Clauses approved by the European Commission for such transfers.

7.3 Additional Rights for California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: Request information about the categories and specific pieces of personal information we have collected about you
  • Right to Delete: Request deletion of your personal information
  • Right to Correct: Request correction of inaccurate personal information
  • Right to Opt-Out of Sale/Sharing: We do not sell or share your personal information for cross-context behavioral advertising
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights

We do not sell personal information. We have not sold personal information in the preceding 12 months.

We will respond to verifiable requests within:

  • 30 days for GDPR requests (extendable by 60 days for complex requests)
  • 45 days for CCPA requests (extendable by 45 days for complex requests)

8. Children's Privacy

Gone is intended for users who are at least 18 years old. We do not knowingly collect personal information from anyone under the age of 18. If you are under 18, please do not use the App or provide any information to us.

If we learn that we have collected personal information from a user under 18, we will delete that information promptly. If you believe we may have collected information from a person under 18, please contact us at legal@gone.travel.

9. International Data Transfers

Gone is operated from the United States. If you access the App from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

For users in the EEA, UK, or Switzerland, we implement appropriate safeguards for international transfers, including Standard Contractual Clauses approved by the European Commission.

By using the App, you consent to the transfer of your information to the United States.

10. Third-Party Links and Services

When you choose to book a flight, Gone redirects you to third-party websites such as Google Flights. These third-party services have their own privacy policies, and we encourage you to review them. We are not responsible for the privacy practices of third-party websites or services.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of this Policy
  • Notify you through the App or by email (if you have provided one)
  • For material changes affecting your rights, provide at least 30 days' notice before the changes take effect

Your continued use of Gone after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.
